Top-Rated New Orleans Car Accident Attorney, Keith L. Magness
Keith and His Legal Team Will Aggressively Fight for Your Rights, and Ensure You Receive the Outstanding Client Service and Maximum Compensation You Deserve!
From the moment of an auto accident, the insurance company has a team of experts working to minimize the compensation a victim deserves. That’s why I take such great pride in being a shield and an advocate for my clients throughout New Orleans. My goal is to ensure you are treated fairly by the insurance company, receive the medical attention you need, and the honest compensation you deserve.
Having lost my mother in an auto accident when I was in law school, I know how overwhelming and confusing the burden of an injury claim can be following an accident. No one wakes up in the morning thinking “I’m going to be in a car accident.” But for someone that has been injured in an auto accident as a result of someone else’s carelessness, they don’t have to go it alone. My job is to provide guidance and shield people through the process, so that they can focus on their path to getting better and moving on.
For accident victims, my consultations are always free. And here for you, anytime 24/7.
Because hiring the right attorney is a very important decision (since you only have one shot to get the full and fair compensation you deserve), there’s a couple other things I would like folks to know:
I offer a 100% client satisfaction guarantee. Clients can walk away anytime within the first 30 days of our relationship – no questions asked.
Not only do clients pay nothing unless we recover money on their behalf. But my fee is up to 25% less than most personal injury firms in New Orleans. Our fee is 30%*, instead of 40%. That’s because I believe in fairness and want to ensure my clients keep more of the money they deserve.

Focusing Only on Car, Truck and Motorcycle Accidents – and You!
If you were to take a moment and look at other personal injury law firm websites around town, you’ll notice that most try to be all things to all people. That is, in addition to car, truck and motorcycle accident victims, they try to represent slip and fall victims, nursing home abuse victims, medical malpractice victims, defective drug victims, etc. Whereas our firm is 100% focused on car accidents in New Orleans.
Unlike other New Orleans law firms, Attorney Keith Magness and the Law Office of Keith L. Magness, LLC focus on one thing: auto accident cases. This focus has allowed Keith to become a “go-to-guy” for auto, truck and motorcycle accident claims, resulting in his selection as a Top 100 Trial Lawyer by the National Trial Lawyers Association – an honor extended solely to the most qualified attorneys from each state who demonstrate superior qualifications of leadership, reputation, influence, statute and public profile.
Top-Notch Client Service At A Fair Price
LOWER ATTORNEY FEES → YOU KEEP MORE OF YOUR MONEY
We Charge Lower (and More Fair) Attorney Fees So You Can Keep 25% More of Your Money.
Many New Orleans personal injury law firms charge a 40% attorney contingency fee for car accident cases. Not us.
That Means You Keep More of Your Money!
IF WE DON’T WIN. YOU DON’T PAY US!
We Work For Free Unless We Recover $$$$ for You
We work on a contingency fee basis auto accident injury cases. This means that you pay us nothing – NO FEES, COSTS OR EXPENSES – from our initial investigation of the case, through the trial and appeals process, unless on our team recovers money for you.
We also front the expenses for your claim, such as police report fees, postage, copies, medical records, investigations, etc. These costs are then taken out of the settlement you receive from the insurance company, along with our fee.
Finally, you may hear other attorneys advertising “no fee unless they collect,” or a “no fee guarantee.” It is important to note that is what a contingency fee is. It simply means that the payment of attorney’s fees is contingent upon there being some kind of recovery. The Law Office of Keith L. Magness, LLC difference is that we offer a lower 30%* contingency fee for auto accident cases, which of course means you will always keep more of YOUR $$$$ if you hire us to represent you!

“Amazing people to do business with and they truly go out of the way to get you everything you deserve.”
— Craydell Vernon
“I was scared and nervous, anxious about paying for my medical bills. [Keith] helped me move forward, scheduled my doctors appointments, helped me understand everything in my case, and maximized the money recovered. They called and made sure everything was okay with me and my daughter. They became family to us.”
“I got in a car wreck and tried to handle it on my own. I felt the insurance company was being unfair so I called Keith. Three weeks later Keith got me over three times what they had offered me on my own.”

My Three Exclusive Guarantees
After the death of my mother following an auto accident while I was in law school, I went through the legal process and felt the frustration that so many people experience when dealing with the insurance company and personal injury lawyers.
So when I opened my own practice, I decided I was going to do things differently to ensure that my clients were treated fairly and honestly throughout the entire process, not only by the insurance company but by my representation as well.
As a result of that experience, I came up with the following three exclusive guarantees to ensure that we as a firm are delivering the superior, “wow” service experience that our clients deserve:
100% Satisfaction Guarantee: If you’re not satisfied with how we are handling your case, you can walk away and we will waive our fee.
We will put more cash in your pocket than what the insurance company has offered, or we will waive or reduce our attorney fees.
You will receive money in your pocket, regardless of the cost of medical bills, or we will waive our attorney fees.

If you are not completely satisfied with the service that we provide at our firm, or you are simply unhappy in the way we are handling your case, you can walk away any time within the first 30 days of our relationship – no questions asked!
At many other law firms, if a client were to leave, the law firm would be entitled to quantum meriut, which means “as much as he deserves” in Latin. Essentially the client would owe the firm compensation for work already performed on their behalf.

Should I Trust the Insurance Company?
The reality is that the insurance company is not on your side. Following an auto accident, their team of experts has one goal: to minimize the compensation they pay you. The nice person you speak to from the insurance company is not your friend. They are highly trained investigators, who are building their case so your claim against them is as small as possible. They are not bad people. They are just doing their job. But, I can assure you, they are not on your side.
The insurance company is already at work to minimize your claim. So you need someone working for you and your family. Do you think you cannot afford to take them on? Well, you can. Our legal team will work for free unless we get results for you. Our policy for all car accident and wrongful death cases is simple: you pay us nothing – NO FEES, COSTS OR EXPENSES – unless our team gets money for you. You have nothing to lose and everything to gain. Our consultation is free and there is no obligation. Let us help you win, and receive the full and fair compensation you deserve.
Put our years of experience working for the insurance companies to work for you!
Prior to formation of his own law practice, New Orleans car accident attorney Keith Magness worked directly for many of the major auto insurers in the metropolitan New Orleans area (Allstate, State Farm, Liberty Mutual, Metropolitan, and Safeco to name a few). Let us put our inside experience to work for you today. If we are unable to come to fair terms with the insurance companies, we will take them to court and fight for you!

Should I Contact an Attorney for a Car Accident?
If you or a loved one has been injured in an auto accident, consulting and hiring the correct injury attorney may be one of the most important decisions of your life. After an accident you only have one chance to recover the fair and honest compensation you deserve to pay for your injuries, medical treatment, pain and suffering, lost wages, and property damage. The insurance industry handles thousands of claims a day. They have experts working from the moment of the accident to minimize the compensation that you deserve. I represent everyday people just like me, against this system, and take great pride in being my clients’ advocate to ensure that they are treated fairly and being a shield between them and the harsh reality of the situation.
I’ve walked a mile in your shoes. I understand how overwhelming and how much of a burden the process is following an injury claim or the death of a loved one, to find out that someone you love or know has been injured or, worse yet, killed in an accident. Oftentimes, when clients contact us right after an accident, they’re confused, they’re scared, and have never been through this process before. They don’t know which way to turn and what to do next. We provide them guidance. We explain the process to them. They come away from this incident in a much better position, much better condition. That confusion and uncertainty is taken off of their shoulders so they can begin their path of healing after this tragic incident.
No amount of compensation could ever fully repair the damages that one has suffered. No amount of compensation will bring a loved one back who’s been lost in an accident. But through our work, we’re able to bring people as close as possible to their pre-accident condition and ensure that they’re treated fairly and justly. If you or a loved one has been injured as a result of somebody else’s carelessness, you need guidance. You need somebody there to help you through that process. Don’t try and do it alone. Let us be your shield through this process to ensure that you’re treated fairly and you receive and keep more of the compensation that you deserve.

Do I Have an Auto Accident Case?
If you’ve been in an auto accident in New Orleans, there are several important factors that will determine if you have a personal injury case and can recover damages:
- The accident was someone else’s fault
- There is visible damage to your vehicle
- You were injured, and sought medical treatment shortly after
- The accident occurred less than one year ago
- You had liability insurance coverage at the time of the accident
How Much is an Attorney for a Car Accident?
Not only do our clients pay absolutely nothing unless we recover on their behalf. But my fee is up to 25% less. While many personal injury firms in New Orleans charge their clients 40%, our fee is only 30%*. That’s because I believe in fairness, and want to ensure my clients keep more of the money they deserve.

How can we charge lower fees than other lawyers for car accident cases?
Clients often ask how we can charge so much less than other personal injury lawyers (especially those seen on TV). The answer is really quite simple: The TV lawyers have to charge more money because they have to pay for the TV ads! Television advertising is expensive, and costs tens of thousands of dollars per month. We don’t advertise on TV. Instead, we put the money the firm would have spent on TV ads in the pockets of our clients through the use of a discounted fee. Our clients then do our advertising by “spreading the word” about our firm and referring their friends and family. Everybody wins and, most importantly, our clients keep more of their money $$$$!
If I’ve been in a car accident in New Orleans, what do I do?
Stay calm and do not leave the scene. Call the police immediately and report the accident. Let them know if you believe you require medical attention. If you are able to move around, exchange contact and insurance information with the other driver, and note the names of any witnesses to the accident. Give the police an accurate and complete description of what happened, and keep any documentation the police give you regarding the accident and an accident report. Be factual and truthful in your description of the accident, but resist any inclination to be apologetic just to look good or get along. It is important to be accurate in what you tell the police officer, not to apologize or be agreeable.
How soon should I file a lawsuit after a car wreck?
That question depends on a number of factors. No matter what, though, you should contact an attorney as soon as possible if you believe that you have a claim. All legal claims must be brought within a specific period of time after the accident, and the more time we have to prepare your case the better. Additionally, it is sometimes important to speak with an attorney soon after the accident so that crucial evidence can be examined or preserved or important witnesses be interviewed when their memories are still fresh.
I’m not sure I can afford an auto accident attorney. Should I still call one?
Yes! Our firm takes most personal injury cases on a contingency basis. This means that rather than you paying us up front, we are paid by receiving a set percentage of whatever award we are able to get you. If you don’t recover any money, neither do we. Nor do you incur any costs or expenses.
If I may have been partly at fault in my car accident or other claim, should I still seek legal advice?
Yes! Louisiana (including in New Orleans) provides for what is called “comparative fault,” and courts will allocate recovery based on each party’s fault. This is another reason that, when you speak to the police officer, you should try to stick to the facts being asked about, and not leap beyond them to apologies or your own conclusions about fault. It may well be that, although you feel responsible, an impartial fact finder would apportion only a small percentage of the fault to you.
I have a preexisting medical condition that was aggravated in my auto accident. Can I still pursue a claim?
Yes, in some circumstances you can. Courts recognize that aggravating a pre-existing condition can be an injury in and of itself. Make sure you let us know about this condition when you come in so that we can be fully informed.
I think I have an accident injury claim, but there are certain things that work against me. Do I have to tell my attorney about these?
Yes, you should definitely tell your attorney everything about your case. Your attorney is your advocate, but he or she can’t fully work for you unless he or she knows all of the facts. If there are facts that work against you, your attorney will be more able to deal with them if he or she knows about them in advance. Make sure you give your attorney a complete picture of what happened.
After an auto accident, what should I bring with me when I meet with my lawyer?
You should bring any and all relevant documentation you have. In a personal injury case, including a motor vehicle accident, this will include the police report, your insurance card and driver’s license, and any notes you have regarding the other driver’s insurance information. Also bring any photographs you may have of the scene of the accident. Many clients also find it helpful to write down the facts of their case so that nothing gets left out. Additionally, if you are dealing with pain or are missing work because of an injury, it may be a good idea to find a calendar with blank space on it and keep a record, day by day, of what complaints you have and the amount of work you had to miss.
How long will it take to get a fair settlement offer for my car accident case?
In New Orleans, personal injury lawsuits can vary in length from weeks to years in some instances. At the Law Office of Keith L. Magness, LLC, we will thoroughly investigate your claim to make sure you get all the money you deserve as quickly as possible.
Will I have to go to court as a result of my accident injury case?
If the insurance company agrees to pay what we believe your case is worth, and you decide to settle for that amount, then you don’t have to go to court. However, if the insurance company won’t or doesn’t offer what we believe your case is worth, we are prepared to take them to battle and fight for you!
